Wyoming argues that the Secretary of State cannot challenge the term limit law

The state of Wyoming says Secretary of State Max Maxfield has no legal basis to file a lawsuit over term limits for state elected officials.
 
     In a recent filing with the state Supreme Court, Wyoming Attorney General Greg Phillips argued that because Maxfield has not said whether he will seek a third term he hasn't been harmed by the term limit law.
 
     Maxfield is challenging the constitutionality of the two-term restriction on the governor, treasurer, auditor, superintendent of public instruction and his office. Maxfield is in his second term as secretary of state.
 
    Maxfield's lawyer contends Maxfield's rights are being violated now because the law prevents him from even announcing his possible candidacy.
